This is a Supreme Court shit show that is as much about the alarmist culture of our era, #me too still finding its feet, and the divisiveness fomented by the current administration.
Here’s my breakdown:
- I like a balanced court and don’t like how the randomness of mortality can impact decades of Constitutional interpretation. I think it’s one of the biggest fundamental flaws in the tri-cameral system. That said, independent of my political philosophy, I think the seat should be filled with someone to keep the “average” in the middle. I can’t stop thinking about the West Wing episode that brought in two extremes to the Bench. And Glen Close was magnificent…
I never get tired of that show.
I don’t hold Kavanaugh responsible for his shitty High School behavior. Yeah, I know a dozen of those high school assholes from Exeter or Choate Rosemary Hall…but I look back at them as poor products of their parents. Yes, high school boys need to learn accountability for their actions and change begins there, but at sixteen years old, there has been very little self-directed personal development. I don’t like hearing about Kavanaugh’s dipshittery high school activities, but I don’t think it precludes his appointment or washes away decades of dedicated juris prudence.
- The third item is the easiest and most instructive. In hiring, we have a simple rule — “if you’re not sure, then it’s a no”. That’s it. It’s too big a risk to bring in the wrong person, and my belief is that the SCOTUS gig carries even greater risk, so my answer to Kavanaugh is “no”.
